What is the difference between a Will and a Trust?
In the simplest of terms a Last Will and Testament (often referred to as a “Will”) is a legal document that allows someone to name beneficiaries who will inherit the assets they own after death.
A Trust on the other hand is a legal arrangement that appoints someone to manage and control assets (a Trustee).
The biggest differences are:
1. A Will takes effect after someone passes away whereas a Trust takes effect immediately upon signing and funding.
2. A Will has to go through Probate for beneficiaries to get the assets whereas a Trust does not.
