Your Will might be useless if you store it in the wrong place.
A lot of people think a copy of their Will is enough but what most people don’t realize is:
Probate courts often require the original signed Will.
In fact, in Florida, a Will must be deposited by its custodian within ten (10) days after receiving information that the testator (the person who authored the Will) has died. See Florida Statute 732.901.
If an original Last Will and Testament can't be found, it can delay probate or even create legal issues. That’s why it is important to make sure your original legal documents can be found. Estate planning doesn’t end when the documents are signed.
At Brett Legal, we routinely draft legal documents including Last Will and Testaments, Living Trusts, and advance directives. Visit our Contact Us page to schedule a 15-minute consultation and learn more about how Brett Legal can help you with your planning.
Sincerely,
Silvia A. Brett, Esq.
